These terms are an agreement between you and Smith's Taylored Solutions LLC ("we", "us") for using Kiddo Flow, OutScouted and their websites and apps (each an "App"). By using an App, you agree to these terms. If you use an App for an organization, such as a childcare center or a school team, you agree on its behalf.
Each App also has its own terms that you accept inside it: the Kiddo Flow Terms of Service and Refund Policy, and the OutScouted Service Agreement in your OutScouted dashboard. If those App terms conflict with this page, the App terms control for that App.
Accounts
You must be at least 18 to create an account. Keep your login details secure and give accurate information. You are responsible for what happens under your account. Tell us right away if you think it has been used without permission.
Acceptable use
Do not use an App to break the law, harass anyone, upload content you do not have the right to share, try to access accounts or data that are not yours, or interfere with how the App works. Only add information about other people, including children or players, that you are permitted to share.
Your content
You keep ownership of the content you add. You give us permission to store and process it only as needed to run the App for you. Our Kiddo Flow and OutScouted privacy policies explain how we handle it.
Paid plans
Kiddo Flow subscriptions are agreed with each center. Tuition that families pay through Kiddo Flow is processed by Stripe and goes to the center, not to us. OutScouted memberships are sold per season. Prices and what each plan includes are shown before you buy. Any purchase made through the Apple App Store or Google Play is also subject to that store's terms, and refunds for those purchases are handled by the store.
Third-party services
Apps connect to services we do not control, such as GameChanger, Stripe and Google. Your use of those services is governed by their own terms.
Our software
The Apps, including their design, code and report formats, belong to us. You may use them only as these terms allow.
Ending your use
You can stop using an App and delete your account at any time; see Delete your account. We may suspend or close accounts that break these terms.
Disclaimers
The Apps are provided "as is" without warranties of any kind, to the extent the law allows. Kiddo Flow is a record-keeping and communication tool. It does not provide childcare and does not replace a center's own safety procedures or licensing obligations. OutScouted reports are based on available game data and may contain errors.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us for the App in the 12 months before the claim.
Apple-specific terms
If you downloaded an App from the Apple App Store, these terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the App and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of the State of Arkansas, USA, without regard to its conflict of law rules.
Changes
We may update these terms. If we make material changes, we will update the effective date and notify users in the App or by email.
